Please read these Terms and Conditions carefully prior to participating in the Volkswagen Instagram Photo Competition, which is an independent photo contest (the “Contest”) for the Irish Instagram community.
The Contest is promoted by Volkswagen Group Ireland Ltd., (The Promoter) Block C, Liffey Valley Business Campus, Liffey Valley, Dublin 22, Ireland.
The Contest is managed by Connector (the Organiser) based in Connector Studio, 18 Eustace Street, Temple Bar, Dublin 2, Ireland.
Everyone who participates (the ‘Participants’) in The Contest fully and unconditionally agrees to and accepts these Terms & Conditions.
‘Content’ or an ‘Entry’ refers to a photo or a video entered into the Contest.
The Website for The Contest is www.vwsnapshot.ie
Eligibility for Participation: The Contest is only open to individuals who, at the time of entry: are resident in the Republic of Ireland and must be over 16 years of age. Proof of identity, age & address may be required by shortlisted Participants during a final screening process to be conducted by The Organiser once the Contest has closed.
Participation Period: The Contest is open for participation from midday on 1st May 2017 until 6PM on 30th June 2017.
Ownership of Photos / Videos: All entries must be owned and submitted by the Participant on their own Instagram profile.
Instagram account permissions: In order to be entered in the competition the Instagram account used to upload the photo must have its permissions set to 'Public'. Photos from accounts set to private will not be entered into the competition or appear on the website.
Permission: By participating in the Contest, the Participants give permission for the entries (i.e. photos, videos, Instagram username of Participants) to be uploaded to The Website. Participants also must have permission from people featured in the Content.
Unlimited Entries: There is no limit to how many times someone can enter the contest with one photo / video or with different photos / videos.
Enter via Instagram: The Participants enter the Contest by uploading their own photos / videos through the free Instagram app. The app can be downloaded via the App store and Google Play Store.
The Photos / Videos: The Participants enter the Contest by tagging photographs relevant to the category they are uploading, via the Instagram app.
Instagram Hashtags: The mandatory hashtag is #VWSnapshot
Hashtag Rules: To be entered into the Contest, each Entry must include the main mandatory hashtag #VWSnapshot and a correct category hashtag (e.g. #RoadTrip, #Abstract, #Volkswagen or #Technology). All category hashtags can be found on www.vwsnapshot.ie
Copyright: Participants who enter Content into the Contest retain the copyright of the Content entered but the organisers and Volkswagen retain the right to use any of the Content entered. If Content is to be used, The Organiser policy is to notify the Participant and give credit to the Participant.
Checking Entries: You can check and find your valid Entry on The Website by searching for your Instagram username. Failure to use minimum two correct hashtags will mean your Content will not be entered in the Contest.
Staff Restrictions: The contest is not open to staff of Connector and Volkswagen Ireland (be they employees or contractors), their immediate family members or associated companies, including (but not limited to) the Contest’s promotional partner(s). For these purposes an “immediate family member” includes a spouse, partner, child, stepchild, grandchild, brother, step-brother, sister, step-sister, parent, step parent or legal guardian.
How To Win: The top 10 entries with the most votes per category get shortlisted for the judging phase.
Multiple Votes: To vote for a photo / video, you must login on The Website using either Instagram, Facebook or Twitter logins. If you login with each social network, one at a time, you will have a maximum total of three votes per photo.
Voting: You may ask your friends and members of the public to vote for your Content through the vwsnapshot.ie/privacy website – sharing an Entry helps increase the chances of more votes.
Judging: The shortlist with the most votes go to our judging panel. The judges are chosen from Volkswagen, Connector and some expert photographers.
Judging criteria: the photos will be judged based on their relevance for the category, distinctiveness and artistic merit.
Judging Process: The judges review the shortlist and give points to their favourite entries. Equal Votes: When there are two or more entries with the same number of votes in a category, we will take the top 10 photos for the shortlist. If there is a tie for the 10th position, all will go onto the Shortlist phase, which the judges will then vote upon.
Expenses: All Participants are responsible for any costs or expenses incurred by them as a result of participating in or winning the Contest.
Winners Announced: The winners of each category will be announced on 14th of July 2017 on the website and on the Volkswagen Ireland social media profiles. The overall competition winner will be chosen by a special panel of judges and will be announced on July 17th on the website and on the Volkswagen Ireland social media profiles.
The Prizes: Each category winner will receive a different prize for winning their category;
12 ‘Volkswagen Favourite’ winners will also be part of a special Volkswagen charity calendar and will win a trip to Wolfsburg, Germany, the home of Volkswagen.
Non-transferable: The prizes are as stated, are not transferable to another individual and no cash or other alternatives will be offered. In the event of a prize being unavailable, the promoter reserves the right to offer an alternative prize of equal or greater value. The winner of the Volkswagen category must have a valid driving license in order to drive the new Golf.
Winner Publicity: The winner(s) agree(s) to the use of their name, their likeness and photos and will co-operate with any other reasonable requests by Connector and Volkwagen to any post-winning publicity.
Winner Promotion: The winners agrees that his or her Content may be used by The Promoter for general media and marketing purposes without remuneration with the goal to promote the talents of the winners. The winner(s) agree(s) to the use of their name, likeness and Content and will co-operate with any other reasonable requests by The Organiser relating to any post-winning publicity as it is mutually beneficial.
Losing Prize: Failure to meet the eligibility requirements may result in forfeiture of the prize. Runner Up: If the Participants receiving the most votes have breached any of the terms and conditions, the Participants receiving the runner up will be deemed the winner.
Unsportsmanlike Behaviour: The Organiser reserves the right at its sole discretion to disqualify any Participant it finds to be tampering with the entry process or the operation of the Contest; to be acting in violation of these Terms and Conditions; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or contestant.
Content Policy for Photo Uploads: The Organiser reserves the right to reject entries to the Contest: All Entries into the Contest are subject to The Organiser’s approval after being uploaded to the Instagram app. All entries that are deemed inappropriate and/or offensive will not be considered. Our Content policy prohibits images containing nudity or sexually explicit material, or Content that is otherwise deemed offensive to any minority group. The Organiser reserves all rights to decide what is considered inappropriate and/or offensive. Participants agree not to create or submit a profile or any picture or video in connection with their Entry into the Contest that is: slanderous, defamatory, derogatory, or slanderous; is pornographic, or otherwise sexually explicit; includes offensive language; portrays violence; portrays or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, portrays or promotes illegal activities; portrays dangerous stunts; promotes bigotry, racism, hatred or harm against any group or individual. If The Organisers discovers that any material submitted by Participants include any such elements or is otherwise inappropriate and/or offensive, then the Entry will be rejected. In addition, in the event that a profile, picture or video is determined by The Organisers, in its sole discretion, to infringe on the intellectual property of any third party, The Organiser may likewise reject the Entry.
Suspend a Participant: The Organiser reserves the right, in its sole discretion, to remove any photos, or to deny, restrict, suspend, or terminate a Participant’s access to all or any part of the website at any time, for any or no reason, with or without prior notice or explanation, and without liability.
Liability: The Organiser and the Participants are liable for any claims subject to the Contest under the usual Irish law, subject to the qualifications below.
Operational Issues: The Organiser is not responsible for any lost, late, misdirected, stolen, illegible or incomplete entries. If, for any reason, the Contest is not capable of running as planned, caused by e.g. infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of The Organiser which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, The Organiser reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and/or select winners from all eligible entries received prior to the cancellation. The Organiser reserves the right to correct any typographical, printing, computer programming or operating errors at any time.
Technical Issues: The Organiser is not responsible for any incorrect or inaccurate information, caused by any of the equipment or programming associated with or utilised in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest. The Organiser assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Organiser is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Organiser is not responsible for any injury or damage to any Participant or to any computer related to or resulting from participating or viewing photos in connection with this contest.
Limitation on Liability: In no event shall The Organiser and/or The Promoter be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising from your Entry into the Contest. Jurisdiction & Amendments
Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the Irish law and the courts of Ireland shall have exclusive jurisdiction in relation to any disputes arising out of or in connection with the Contest.
Amendments: The Organiser may modify the Terms & Conditions and such modification shall be effective upon posting on the webpage vwsnapshot.ie/privacy.
